Subclass 820/801Partner VisaThis two-stage visais applied together with only initial visa application charge. It lets the De Facto partner or spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia. Stage1 is subclass 820 onshore temporarypartner, visa which leads to stage 2 subclass 801 permanent residency visa which is granted once the subclass 820 visa holder completes two years in married relationship meeting the visa criteria. The 820 and 801 visas may be granted on the same day if partner visa applicant and his/her sponsor are in a long-term married or long-term De Facto relationship.

Subclass 309/100 visa-This two-stage visais applied together with only initial visa application charge. This visa is foroffshore spouse(living outside Australia)of an Australian citizen, Australian permanent resident or eligible New Zealand citizen live in Australia. Stage1 is subclass 309temporarypartner, visa which leads to stage 2 subclass 100 permanent residency visa which is granted once the subclass 309 visa holder completes two years in married relationship meeting the visa criteria. The visa applicant must be offshore at the time of visa application and at the time of grant of this visa.

Subclass 300 Prospective Marriage visa (PMV) or (fiancé visa). This visa is for people who are planning to get married to an Australian citizen, an Australian permanent resident, or an eligible New Zealand citizen. Once your visa application has been approved, you can move to Australia to marry your sponsor. You can also have your wedding overseas if you like! The PMV is granted for 9 months, you are expected to get married within that 9 month and the 9 month starts from the date the visa is granted.

PMV holders can apply for an 820/801 visa once they have married their sponsor, which then provides a pathway to permanent residence. The visa applicant must be offshore at the time of visa application and at the time of grant of this visa.

The visas allow you to enter and remain in Australia based on your married or de facto relationship with your partner (in the case of prospective marriage you must marry your sponsoring partner within 9 months of grant of subclass 300 visa). Your sponsoring partner must be of 18-year-old and meet one of the followings:

  • An Australian citizen
  • An Australian permanent resident
  • An eligible New Zealand citizen
